The term “Customer” refers to any individual over the age of 18 to whom SARL Guillaume Fourrier provides recreational fishing guidance and support services.

Contract

The term “Contract” refers to the agreement between the Customer and Guillaume Fourrier.

Instructor

The term “Instructor” refers to professional fishing guide Guillaume Fourrier, who holds BPJEPS and UCC “Leisure Fishing in Marine Environments” certifications. His professional educator license number is 07623ED0276.

SARL Guillaume Fourrier

The term “SARL Guillaume Fourrier” refers to the sole proprietorship SARL Guillaume Fourrier, headquartered at 4 Rue du Général Leclerc, 76370 Dieppe, France, registered with RCS Dieppe under number 982 326 100 and APE code 8551Z.

General Terms and Conditions of Sale for Individuals

These terms and conditions:

Any service performed by SARL Guillaume Fourrier implies the customer’s unreserved acceptance of these general terms and conditions. The customer acknowledges having read and fully accepted them when they are accessible on the Website.

Any condition contrary to these terms and conditions will not be enforceable against SARL Guillaume Fourrier unless expressly accepted.

SARL Guillaume Fourrier regularly updates its terms and conditions to align with customers expectations and applicable laws. The terms and conditions accessible on the Website at the time of the Contract shall apply. These are deemed approved by the customer unless otherwise stated within two (2) weeks.

The customer is permitted to reproduce the terms and conditions accessible on the Website.

Services

SARL Guillaume Fourrier offers recreational and sport fishing guidance, training, and support in the context of physical, sporting, and well-being activities. Each session is provided by a professional and qualified Instructor.

Service Duration:
Service durations are defined according to the customer’s choice among the packages offered on the Website. Each service includes:
– Welcome and orientation.
– Safety equipment setup.
– Transport to the fishing zone.
– Fishing activity.

Organization and Scheduling

Session bookings are made directly with the fishing guide, who determines the meeting location. For group sessions, all participants must arrive at the specified location.

Delays, Absences, Cancellations, and Suspensions

Customers must adhere to the defined schedule. Once booked, a session cannot be canceled and will remain due. Sessions may, however, be rescheduled if the customer requests it at least 48 hours in advance and subject to the Instructor’s availability. Delays caused by the customer will automatically reduce the session duration.

The Instructor must make up for any delay on their part at the end of the session.

SARL Guillaume Fourrier may cancel a fishing session up to six (6) hours prior due to adverse weather conditions. Customers will be informed via call (or SMS if unreachable), and the session will be rescheduled.

SARL Guillaume Fourrier shall not be held responsible for delays in service execution due to force majeure, such as extreme weather or accidents. Customers will be notified as soon as possible, and sessions will be rescheduled.

Physical Condition

The customer must be in a physical condition compatible with sport fishing activities. SARL Guillaume Fourrier shall not be held liable for:
– Aggravation of undeclared symptoms caused by navigation conditions (e.g., back pain, joint pain, sciatica).
– Allergic reactions (to sunlight, saltwater) or other medical issues not disclosed beforehand.

Internal Rules

The customer must wear appropriate attire for outdoor nautical activities. The Instructor may provide suitable clothing for rainy or splash-prone conditions.

The customer is responsible for their health and safety and must follow the Instructor’s instructions.

Shortened sessions due to medical issues or seasickness will not be refunded.

If a participant requests to return to port early during a group session, the group must agree, and additional fuel costs may apply if the session is extended for other participants.

SARL Guillaume Fourrier reserves the right to terminate the Contract without notice or compensation if a customer’s behavior is deemed inappropriate, disruptive, or dangerous.

SARL Guillaume Fourrier is not liable for any loss, damage, or submersion of customer belongings. It is advised to store sensitive items in waterproof pouches.

Duration and Termination of the Contract

The Contract ends:
– Upon completion of all booked sessions.
– When the validity period expires without the customer completing all sessions due to their actions or omissions.

The full price remains due unless the partial completion results from SARL Guillaume Fourrier’s actions.

The customer cannot terminate the Contract unless due to force majeure (e.g., medical reasons or accidents). In such cases, SARL Guillaume Fourrier will refund unused sessions.

Rates and Payment Terms

– Prices are in euros (€) including taxes.
– The customer must pay 30% upon booking and the remaining balance once the Instructor confirms favorable weather conditions within 7 days of the session.

Insurance and Liability

– Customers are advised to have personal accident insurance for physical activities.
– SARL Guillaume Fourrier’s liability applies only in cases of proven gross negligence directly causing damage.
– Indirect damages (e.g., financial losses) are not covered.

Personal Data

Customers data is collected solely for service execution and may only be used for marketing with written consent.

SARL Guillaume Fourrier may take photos/videos during activities, which can be used for promotional purposes unless the customer objects in writing.
